1. Acceptance of Terms
By accessing or using MailCraft ("Service"), a product of STEPlus Technologies ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
MailCraft is an AI-powered email marketing platform that enables users to create email templates, manage subscriber lists, build audience segments, send email campaigns, and track engagement analytics. The Service includes AI-assisted content generation, spam scoring, and deliverability analysis tools.
3. Account Registration
To use the Service, you must register for an account through our identity platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must be at least 18 years old to create an account and use the Service.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited emails (spam) or violate anti-spam laws including CAN-SPAM, GDPR, and CASL
- Transmit malware, phishing content, or fraudulent material
- Harvest email addresses or personal data without consent
- Send emails to purchased, rented, or scraped email lists
- Impersonate any person or entity, or misrepresent your affiliation
- Violate any applicable local, national, or international law or regulation
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to any part of the Service
5. Email Sending and Compliance
You are solely responsible for ensuring that your email campaigns comply with all applicable laws and regulations, including but not limited to the CAN-SPAM Act, the General Data Protection Regulation (GDPR), the Canada Anti-Spam Legislation (CASL), and any other relevant anti-spam or privacy laws. All marketing emails sent through the Service must include a functioning unsubscribe mechanism. We reserve the right to suspend or terminate accounts that violate email sending policies or generate excessive spam complaints.
6. Content Ownership
You retain all rights to the content you create, upload, or transmit through the Service, including email templates, subscriber data, and campaign content. By using the Service, you grant us a limited license to process, store, and transmit your content solely to provide and improve the Service. We do not claim ownership of your content. AI-generated content produced through the Service is owned by you upon generation.
7. Data Processing and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data and subscriber data. By using the Service, you agree to the data practices described in the Privacy Policy. When you process subscriber data through the Service, you act as the data controller, and we act as the data processor.
8. SMTP Configuration
The Service allows you to configure custom SMTP servers for email delivery. You are responsible for ensuring that your SMTP configuration is properly authenticated (SPF, DKIM, DMARC) and that you have authorization to send emails through the configured servers. We are not responsible for deliverability issues arising from misconfigured or unauthorized SMTP servers.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, apply updates, or experience unforeseen outages. We will make reasonable efforts to notify users of planned downtime in advance. The Service is provided on an "as is" and "as available" basis.
10. Limitation of Liability
To the maximum extent permitted by law, STEPlus Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or revenue, whether incurred directly or indirectly, arising from your use of or inability to use the Service.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination. After 30 days, we may permanently delete your account data.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
